Agreement to these terms
OutHere lets you share what you are planning (a signal) with friends you choose, so they can join you. By creating an account or using OutHere you agree to these Terms of Service. If you do not agree with them, please do not use the service.
Your account
A valid phone number is required to sign up, and your account belongs to you alone. Use your own name or a username people know you by, and do not impersonate anyone. You are responsible for activity that occurs on your account. You must be at least 13 years old to use OutHere.
Your content
The content you post (signals, comments, and your profile) belongs to you. You grant OutHere permission to store it and display it to the friends you share it with, which is how the service operates. Do not post anything unlawful, hateful, or harmful.
Zero tolerance for abuse
There is no tolerance for objectionable content or abusive behavior on OutHere. Do not post anything illegal, hateful, harassing, threatening, sexually explicit, or violent, and do not spam, scam, or impersonate anyone. We remove content that breaks this rule and we suspend or permanently remove the accounts behind it, without warning where the violation is serious.
Reporting and blocking
If you see something wrong, tap the menu next to it and report it. Reports are private; the other person is never told who reported them. We review every report and act on the ones that break these terms, normally within 24 hours. You can also block anyone from the same menu: blocking hides you from each other completely, and you can undo it under blocked accounts on your profile.
How signals work
A signal is delivered only to the friends and lists you select, and it expires on its own when the plan's window ends. Recipients can reply, comment, vote in time and place polls, and see who else has joined. Once something is shared, the people you sent it to can view it, so please share thoughtfully.
Text message invitations
OutHere sends two kinds of text: a hangout invitation and a find-a-time request for that same hangout. A first invitation may arrive because a friend personally selected your number from their own contacts; automated texts from our registered number are sent only if you opt in yourself. You opt in on an OutHere invite page: after verifying your phone number with a one-time passcode, you can check an optional box, unchecked by default, agreeing to receive recurring automated text messages from OutHere when friends invite you to hangouts. Message frequency varies: at most one text per person per hangout for each kind, and no more than one text every 30 minutes to a number from any one sender. No marketing or promotional messages, ever. Message and data rates may apply. Reply STOP to any OutHere text to opt out of all future messages, START to opt back in, or HELP for assistance; after you reply STOP we send one confirmation message and nothing further. Consent to receive text messages is never a condition of any purchase or of using OutHere. Your consent applies only to OutHere text invitations and is never transferred or assigned to any other business, including any company that might acquire us. You confirm the number you verify is your own, and if you give the number up, please reply STOP first or tell us so texts never reach a stranger. Carriers are not liable for delayed or undelivered messages.
Your responsibilities when inviting by text
Before OutHere will send any text invitation, you must confirm the attestation shown on the send screen: that you have a direct personal relationship with each contact you selected and their permission to be invited by text. You may invite only people you personally know, using contacts from your own address book. You may not use purchased, rented, scraped, or otherwise third-party lists, and you may not invite anyone who has asked you not to contact them. Accounts that send unwanted invitations may be suspended or removed.
The service
OutHere is provided on an as-is basis. We work hard to keep the service running, but we cannot guarantee that it will always be available or error free, or that every signal will arrive instantly. Features may be added, changed, or removed as the service evolves.
Termination
You may stop using OutHere at any time. To delete your account and everything tied to it, open your profile in the app and tap delete my account; deletion is immediate and permanent. We may also close accounts that violate these terms.
Liability and disputes
To the fullest extent the law allows, THEAPPSFACTORY LLC is not liable for indirect, incidental, or consequential damages arising from your use of OutHere, and our total liability for any claim is limited to one hundred US dollars. You agree to hold us harmless from claims arising out of content you post or invitations you choose to send. These terms are governed by the laws of the State of Delaware, and any dispute will be resolved in the state or federal courts located in Delaware.
General
The OutHere name, app, and website are owned by THEAPPSFACTORY LLC; these terms give you no right to use our branding. Invitation links may open pages that display content posted by other users, which belongs to those users. We may assign these terms as part of a sale or reorganization of the business, except that your text messaging consent and opt-in data are never transferred to any other business, as described above. To report content you believe infringes your copyright, email appfactorybks@gmail.com with the details and we will act on it.
Changes to these terms
These terms may be updated as OutHere evolves. If we make material changes, we will notify you in the app, and continued use of OutHere after such notice constitutes acceptance of the updated terms.
